1. Agreement & Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Merchant", "User", or "Customer") and beanthere Technologies ("beanthere", "we", "our", or "us"), governing your access to and use of https://beanthere.co.in, merchant dashboards, QR ordering web apps, and associated digital dining infrastructure.
2. Zero-Commission Model & Subscription Billing
beanthere operates on a zero-commission model for dining, takeaway, and direct orders:
- 0% Per-Order Commission: We do not charge percentage cuts on order totals.
- Flat Subscription Pricing: Advanced features (KDS, Bites XP rewards, CRM re-engagement, custom themes) are billed as flat-rate subscriptions (e.g. ₹499/month Pro plan).
- 14-Day Free Trial: Merchants entering trial periods receive full access with no credit card required. Trial accounts can be cancelled at any time without penalty.
3. Direct Payment Settlement & Gateway Integration
Payments processed via online payment gateways (UPI, Credit/Debit cards, NetBanking) or counter cash are settled directly to the merchant's registered bank account or UPI VPA. beanthere does not hold or delay merchant funds. Standard third-party payment gateway processing fees (if applicable) are governed by the respective payment gateway partner.
4. Merchant Account Responsibilities & Content Standards
Merchants are responsible for:
- Maintaining accurate menu pricing, availability tags, and allergen disclosures.
- Fulfilling orders submitted by guests in a timely manner.
- Safeguarding merchant login credentials and restricting unauthorized account access.
- Ensuring food preparation complies with applicable food safety standards (FSSAI in India).
5. User-Generated Food Moments & Intellectual Property
Guests uploading food photos ("Food Moments") grant beanthere and the respective café a non-exclusive license to display approved dish photos to highlight menu items. Uploaded content must not contain offensive, misleading, or infringing material.
6. Limitation of Liability
To the maximum extent permitted by law, beanthere shall not be liable for indirect, incidental, or consequential damages resulting from temporary internet outages, hardware malfunction, or third-party payment gateway downtime.
7. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of India. Any legal proceedings arising from platform usage shall be subject to the exclusive jurisdiction of the courts in India.
